These terms are issued under Art. 8 of the Polish Act on Providing Services by Electronic Means (ustawa o świadczeniu usług drogą elektroniczną).

Kaption is a desktop tool that translates in-game subtitles by reading your screen. A free tier is available; paid plans unlock additional features. These are the ground rules.

Kaption is an independent project. We are not affiliated with, endorsed by, or connected to HoYoverse, Cognosphere, or miHoYo. Genshin Impact, Honkai: Star Rail, Zenless Zone Zero, and HoYoverse are trademarks of their respective owners.

// How the app works

Kaption takes screenshots of your screen, runs text recognition (OCR) on game dialogue, and matches it against a built-in dictionary to show translations in an overlay.

It never modifies game files, injects code into game processes, reads game memory, or sends dialogue text over the network. Technically, it works the same way as the Windows Snipping Tool with text recognition on top.

// Game content and trademarks

The translation dictionary contains game dialogue text. This content belongs to HoYoverse / Cognosphere. Kaption uses it solely to provide personal, non-commercial translations as an accessibility aid.

We don't claim ownership of any game content. All game names, characters, and related materials are the property of their respective owners.

// Accounts and paid licenses

You can use Kaption on the free tier without an account. Paid plans (e.g. 30-day or 180-day) require signing in via Google or Discord. One account may be registered to at most two devices at a time.

Payments are processed by LemonSqueezy, acting as our merchant of record. LemonSqueezy handles card processing, tax, and invoicing; we never see your card data. The purchase contract in substance is between you and us — LemonSqueezy processes the transaction on our behalf.

You are responsible for keeping your login credentials safe and for any activity under your account.

// Right of withdrawal (EU consumers)

If you are a consumer in the EU, you normally have 14 days to withdraw from a distance contract without giving any reason, under the Polish Consumer Rights Act of 30 May 2014 (implementing Directive 2011/83/EU).

Kaption's paid plan is digital content delivered without a tangible medium. Under Art. 38 pt 13 of that Act, the right of withdrawal does not apply if performance has begun with your prior express consent and your acknowledgment that you lose the withdrawal right once performance starts.

In practice: when you check the "Start using the license immediately" box at checkout (required to activate the plan before the 14 days run), you waive the right of withdrawal. If you prefer to keep it, you can hold off on activating the license for 14 days and ask us to cancel the order by writing to contact@kaption.one — we will refund in full.

You can use the model withdrawal form from Annex 2 of the Consumer Rights Act, or simply email us within the 14-day window. A template is available from UOKiK.

// No guarantees

The software is provided as-is. A few things we can't promise:

  • -- That translations are always correct. OCR can misread characters, and fuzzy matching sometimes picks the wrong line.
  • -- That the app works on every system or with every game update. Games change, and we may not keep up immediately.
  • -- That game companies won't change their anti-cheat policies. We believe Kaption is safe because it never interacts with game processes, but we can't control what anti-cheat systems decide to flag.
  • -- Continuous availability, updates, or long-term support.

Nothing in this section limits your statutory consumer rights under Polish or EU law.

// Liability

To the fullest extent allowed by law, we are not liable for indirect or consequential damages from using Kaption — including game account actions, data loss, or system issues. You use the software at your own risk.

These limitations do not apply to liability that cannot be excluded or limited by law (e.g. damage caused by intent or gross negligence, or liability under mandatory EU consumer-protection rules).

// Governing law and jurisdiction

These terms are governed by the laws of the Republic of Poland. Any dispute arising out of or in connection with them will be resolved by the Polish courts competent for the seat of the service provider — i.e. Sąd Rejonowy w Stalowej Woli (or the regional court where applicable).

If you are a consumer, the above clause does not deprive you of the protection afforded by mandatory provisions of the law of your habitual residence (Art. 6(2) Rome I Regulation). You can always bring a claim before the court of your own domicile if EU consumer-protection law allows it.

// Out-of-court dispute resolution

EU consumers can use the European Commission's Online Dispute Resolution platform, available at https://ec.europa.eu/consumers/odr/, to file a complaint about a purchase made on our service.

In Poland you can also turn to the Provincial Trade Inspection Authority (Wojewódzki Inspektor Inspekcji Handlowej) or the Consumer Ombudsman (Rzecznik Konsumentów) in your municipality for free consumer mediation. We are not obliged to participate in out-of-court dispute resolution, but we will always try to resolve issues amicably first — write to us before escalating.

// Changes to these terms

We may update these terms. If we do, we'll update the date at the top. For ongoing services, material changes will be announced to affected users at least 14 days before they take effect, and you can close your account before then if you don't accept them.
