End-User License Agreement
Effective: 14 April 2026
This agreement is between you and Kaption (a Poland-based solo developer). Installing or running the Kaption desktop app means you accept these terms. If you don't, uninstall and stop using it. This document covers the desktop app. For the website, see Terms of Service.
// 1. What Kaption does
Kaption reads the pixels of your screen, runs OCR on them, and shows a translated subtitle as an overlay. It does not modify game files, read game memory, inject code into games, tamper with network traffic, or communicate with game servers. It is a passive, screen-reading tool that works the same way accessibility software works.
// 2. Not affiliated
Kaption is an independent project. It is not affiliated with, endorsed by, sponsored by, or connected to Hoyoverse, miHoYo, Cognosphere, or any other game publisher. Names of games and characters belong to their respective owners. Kaption uses them descriptively to identify supported titles.
// 3. Your responsibility with game Terms of Service
You are responsible for knowing the Terms of Service of any game you use Kaption with. Kaption does not instruct you to violate any ToS, and we believe a screen-reading translator is consistent with typical accessibility exceptions. Publishers may disagree. If a publisher decides a particular game's ToS prohibits this kind of tool, you choose whether to keep using it. We don't carry your account for you.
// 4. License grant
You get a personal, non-transferable, revocable license to install and run Kaption on up to three (3) devices that you own or use. You may not sell, rent, sublicense, or redistribute the installer or the app. You may not reverse-engineer the encrypted translation data files, except to the extent local law forbids that restriction.
// 5. Pricing
Kaption is free during its public beta (version 2.x). A paid tier may launch later with extra features. Beta users will receive supporter perks as a thank-you for testing — exact details (e.g. a discount, bonus credit, or trial period on launch) will be announced before the paid tier goes live. Continued use beyond the beta may require a paid plan.
// 6. Revocation
We may revoke your license if you abuse the service — for example, by sharing credentials to circumvent the device limit, by uploading malicious files, or by harassing other users on community channels. Revocation means your activations stop refreshing; the app keeps working until the local grace period expires (default 7 days offline), then requires a new license.
// 7. No warranty
Kaption is provided "as is" without warranty of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. OCR accuracy depends on your screen resolution, game text rendering, and many other factors we can't control. Translations are machine-assisted and not always perfect.
// 8. Limitation of liability
To the maximum extent permitted by law, Kaption is not liable for any indirect, incidental, special, or consequential damages arising from your use of the software — including but not limited to lost game progress, account actions taken by game publishers, or time spent troubleshooting. Our total aggregate liability is capped at the amount you paid us in the twelve months preceding the claim (zero, if you used only the free tier).
// 9. Privacy
See the Privacy Policy. Short version: we store your email and name from OAuth login, and activation metadata tied to a hashed machine fingerprint. We do not store screen contents, OCR results, game files, or keystrokes.
// 10. Updates
Kaption checks for updates in-app. You can decline any update; older versions may stop working if a breaking change to the licensing backend ships. We try to avoid that.
// 11. Termination
You may terminate this agreement at any time by uninstalling. We may terminate for the reasons in section 6. Sections 7, 8, 9, and 12 survive termination.
// 12. Governing law and disputes
This agreement is governed by the law of the Republic of Poland, without regard to conflict-of-laws rules. Disputes are resolved in the Polish courts competent for the publisher's seat, except where mandatory consumer-protection law in your country of residence gives you a right to bring proceedings locally.
